Corporate governance scholarship focuses on executive malfeasance, specifically its antecedents and consequences. Academic efforts primarily focus on prevention while practitioners are often left to hold firms and executives (including directors) accountable through a variety of sanctions. Even so, executive malfea­sance still occurs even in the face of the vast resources used to monitor, control, and penalize firms and executives. In this paper, we posit equity markets do not adequately penalize firms for inaccurate earnings reports. Using a sample of 129 firms (...) identified by the U.S. General Accounting Office for reporting fraudulent earnings in 10K filings, we found support for our assertion. Consequently, the one party who may benefit but escape accountability is firm shareholders. Moreover, we find little empirical evidence that the subset of firms sanctioned by the SEC is penalized more heavily than the full sample by markets at the time they report and correct their 10K filings. Our results raise serious questions whether such mana­gerial opportunism can be eradicated given the apparent lack of consequences in equity markets for investors. We also question whether the SEC is able to discern between fraud and error in financial reporting and its implications. (shrink)

This study expands the application of deonance theory into organizations’ upper echelons by examining how CEOs imprinted with a sense of duty can influence managerial decision-making. We hypothesize an imprint of bounded autonomy, an ought-force that constrains their decision-making and understanding of behavioral freedom, influences duty-bound CEOs to self-report errors in past financial reporting. We test deonance theory propositions of instrumentality for behavioral expansion, namely loss avoidance and gain attainment, related to institutional ownership concentration and CEO equity ownership. We use (...) CEOs that are graduates of U.S. service academies as a proxy for duty-bound executives and find firms they lead are more likely to issue a financial restatement to correct a previous reporting error. This finding is robust to alternate explanations such as being error-prone, earnings management, auditor oversight, and risk behaviors. We also find evidence that deonance may be subject to behavioral expansion. The likelihood of issuing a restatement decreases as institutional ownership concentration and CEO equity ownership increases. This study shows imprinted deonance within the C-suite influences important organizational outcomes. (shrink)

The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research. Constructing these locally finite canonical models involves solving a problem in general modal logic of independent interest, related to the study of adjoint pairs of modal operators: for a given modal logic L, can we find for every formula φ a formula f(φ) such that for every formula ψ, φ → []ψ is provable in L if and only if f(φ) → ψ is provable in L? We answer this question for a number of standard modal logics, using model-theoretic arguments with world semantics. In two of the earliest papers on extending modal logic with propositional quantifiers, R. A. Bull and K. Fine studied a modal logic S5Π extending S5 with axioms and rules for propositional quantification. Surprisingly, there seems to have been no proof in the literature of the completeness of S5Π with respect to its most natural algebraic semantics, with propositional quantifiers interpreted by meets and joins over all elements in a complete Boolean algebra. Kenya has one of the highest remaining concentrations of tropical savanna wildlife in the world. It has been recognised by the state and international community as a 'unique world heritage' which should be preserved for posterity. However, the wildlife conservation efforts of the Kenya government confront complex and often persistent social and ecological problems, including land-use conflicts between the local people and wildlife, local people's suspicions and hostilities toward state policies of wildlife conservation, and accelerated destruction of wildlife habitats. This (...) essay uses a political -ecological framework in the analysis of the social factors of wildlife conservation in Kenya. It postulates that the overriding socioeconomic issue impacting wildlife conservation in Kenya is underdevelopment. The problem of underdevelopment is manifested in forms of increasing levels of poverty, famine and malnutrition. The long term survival of Kenya 's wildlife depends on social and ecological solutions to the problems of underdevelopment. (shrink)

John Wesley explained the existence of evil in moral rather than metaphysical terms. His understanding of the fall was fairly typical of western theology and he also enthusiastically embraced a version of the felix culpa theme as essential for theodicy. Unlike many influential western theologians, he also relied heavily on libertarian freedom to account for evil. His most striking proposal for theodicy involves his eschatalogical vision of the future in which he believed the entire world living then will be (...) converted. I argue that his theodicy is implicitly universalist, especially in its eschatalogical speculations, and show that this is in tension with his strong libertariancommitments. (shrink)

This approach seems plausible if one assumes that to explain an occurrence is to show that it was to be expected or to exhibit its degree of expectability and the factors which influence its expectability. Any doubt that Platonic studies flourishes would quickly be put to rest by the four books under review here.It was once thought that attention to the "dramatic dimension" of Plato's literary-philosophical productions was the province of two much despised schools of thought: "the Straussians," and "the Continentals." The first of these was viewed as advocating a dangerous combination of esotericism (the idea that somehow Plato's meaning is not on the surface of the dialogues, but concealed in them, as though they were a cryptogram), elitism (the idea that the true Plato is only available to [End Page 205] "the few"—such as the Straussians, according to themselves anyhow), and unphilosophical and dilettantish meanderings about this or that literarily cast "teaching." Straussian hermeneutics was thought to open the way to unprincipled appeals to irony whenever it suited the interpreter, so that any text could end up saying pretty much whatever the interpreter wished for it to say, including the opposite of what the surface of the dialogue appeared to say. And further, it was thought (perhaps in a manner at odds with the "unprincipled interpretation" charge) that the Straussians' mode of "taking into account" the dramatic context—and in particular their contextualization of claims made in the dialogues such that this or that claim gets "explained" as a rhetorical gesture addressed by character X to character Y in context Z, a gesture whose content and validity, so to speak, are limited to that exchange—robs the dialogue of its philosophical content. Hence the worry that Straussian hermeneutics leads to skepticism about the possibility of philosophy itself—philosophy understood precisely in the way that it is regularly spoken of in the Platonic dialogues, namely as the effort to transcend perspective and partiality and to grasp through argument the essence of the matter as such. To cap it off, there is the background suspicion that Straussians are politically conservative, in a way that is somehow connected with their interpretation of Plato.There is more than a kernel of truth in the view that Straussians have insisted on the hermeneutic importance of the dialogue form, taking their cue from Strauss's own remarks in such texts as The City and Man. Moderate scientism is the view that empirical science can help answer questions in nonscientific disciplines. In this paper, we evaluate moderate scientism in philosophy. We review several ways that science has contributed to research in epistemology, action theory, ethics, philosophy of language, and philosophy of mind. We also review several ways that science has contributed to our understanding of how philosophers make judgments and decisions. Based on this research, we conclude that the case for moderate philosophical scientism is strong: scientific (...) practice has promoted significant progress in philosophy and its further development should be welcomed and encouraged. The philosophical theory of scientific explanation proposed here involves a radically new treatment of causality that accords with the pervasively statistical character of contemporary science. Wesley C. Salmon describes three fundamental conceptions of scientific explanation--the epistemic, modal, and ontic. He argues that the prevailing view is untenable and that the modal conception is scientifically out-dated. Significantly revising aspects of his earlier work, he defends a causal/mechanical theory that is a version of the ontic conception. Professor Salmon's theory furnishes a (...) robust argument for scientific realism akin to the argument that convinced twentieth-century physical scientists of the existence of atoms and molecules. To do justice to such notions as irreducibly statistical laws and statistical explanation, he offers a novel account of physical randomness. There is an extensive literature in social choice theory studying the consequences of weakening the assumptions of Arrow's Impossibility Theorem. Much of this literature suggests that there is no escape from Arrow-style impossibility theorems unless one drastically violates the Independence of Irrelevant Alternatives (IIA). In this paper, we present a more positive outlook. We propose a model of comparing candidates in elections, which we call the Advantage-Standard (AS) model. The requirement that a collective choice rule (CCR) be rationalizable by the (...) AS model is in the spirit of but weaker than IIA; yet it is stronger than what is known in the literature as weak IIA (two profiles alike on x, y cannot have opposite strict social preferences on x and y). In addition to motivating violations of IIA, the AS model makes intelligible violations of another Arrovian assumption: the negative transitivity of the strict social preference relation P. While previous literature shows that only weakening IIA to weak IIA or only weakening negative transitivity of P to acyclicity still leads to impossibility theorems, we show that jointly weakening IIA to AS rationalizability and weakening negative transitivity of P leads to no such impossibility theorems. WildmanBrains are amazing organs in all creatures with central nervous systems and especially in human beings. But they are not perfect. Without forgetting the larger success story of cognitive evolution, I want to explore the way that cognitive biases sometimes produce errors in both religious and secular social settings and how such errors can be diagnosed (...) and corrected when they occur. This will involve noticing that error diagnosis and correction is a process that certain social groups have a vested interest in resisting or neglecting, in some respects, while the very same social groups may furnish resources that support the detection of cognitive errors, in other respects.This presents a moral quandary for both secular and religious groups. Should we educate children to be fully aware of their cognitive vulnerability to advertising, thereby learning how to resist and eventually become immune to one of the fundamental power sources of modern market economies? Should religious groups explain to young people their cognitive tendencies to posit the action of supernatural beings whether or not any such action exists, even though this may disrupt the power of religious groups to forge bracing social togetherness that supports psychologically useful coping skills? While I do not seek to answer such complex moral questions in this paper, I do argue that knowledge of cognitive biases and the resulting tendencies to cognitive error, self-defeating behaviors, and self-deception should be made available to those individuals and groups who are interested in promoting a high degree of critical self-awareness in the analysis of beliefs and behaviors in both secular and religious contexts.The term "error" is a potentially problematic one in that it misleadingly suggests that there might be a uniquely correct way in which cognition should work. I do not wish to suggest such a binary opposition. After all, biases exist in the human cognitive system either because they have been selected in the evolutionary process for their survival benefits or because they are side effects of other traits selected for their usefulness. My concern is with the wondrous human discovery that we can analyze [End Page 61] our behaviors and beliefs with such precision that we can sometimes detect when our cognitive biases produce mistaken beliefs and self-defeating behaviors. This forms the basis for my contention that cognition can often work better than it does—more accurately, less self-destructively—when tendencies to cognitive error are diagnosed, corrected, and perhaps even systematically resisted.The profound irony here is that the very same social groups (secular and religious) with an obvious vested interest in resisting such enlightenment in some respects can also promote processes of discernment and insight in other respects. Existing literature in the cognitive psychology of religion rarely bothers with such subtleties.
